JP Licks typically serves a Kahlua ice cream flavor. As I recall, they can blend it into a frappe. I don't think they have a liquor license, so how is a frappe not considered a mixed beverage if the ice cream has alcohol regardless of the minute level?

I'm actually thinking of writing an article about this now, mostly because a) I find it bizarre that ice cream shops are refusing to do this (OP, can you tell me which ice cream shop it was where you encountered this?) and b) I also want to know what the hell is up with the Godiva not selling alcoholic chocolates thing.

And I want to talk about the laws about quahaugs and vinegar. Why are there so many laws about vinegar?

I don't know how the particular law works, but a lot of flavorings have alcohol (i.e. vanilla). Could it count as a flavoring?

Soft drinks (sodas) have alcohol in them, especially if the carbonation process is done the "old fashioned" way through fermentation. Also, some flavor extraction processes might introduce alcohol into sodas and juices. Because of this, products that have under a certain amount of alcohol (defined in most countries as 0.5%) are considered to be "non-alcoholic".

As for extracting the alcohol from the ice cream, this is damned easy as water/ice cream turns solid long before alcohol does. They probably just make the ice cream with Kalhua in it and strain the liquid to get it way below the magic 0.5% number.

actually they don't.
Handmade sodas made at home would if carbonated via slight fermentation, but commercial sodas have no alcohol. They're flavored sugar and carbonated water.

Short answer is yeah, shh.

But fwiw the amount of booze you can put into ice cream and still have it freeze is surprisingly low; it's likely there's not enough to raise any eyebrows. Or for that matter, they may be making a syrup that cooks off a lot of the alcohol while keeping the flavor.

There's gotta be a chemist around here who can do a Mythbusters on a scoop or two...

It's completely legal in Massachusetts for businesses without a liquor license to sell food that has been made with alcohol. Ice cream is food.

Now, they can't add more Kahlua to the frappe, because that's "an alcoholic beverage" but once it's in the ice cream, it's food.

This would make sense. But I was just in a Godiva the other day and was told the closest place I could get one of their Champagne truffles was NY cause they needed a liquor license to sell them in MA....I would think truffles would be even more "food" than a frappe (more solid than liquid at least).

I don't know the magic number at which point a beverage is considered non-alcoholic but "non-alcoholic" beer has about 0.5% alcohol in it and you don't need a liquor license to sell that. There are too many seasonings that are dissolved in alcohol (such as vanilla as was referenced above), and too many processes that produce small quantities of alcohol for a complete ban on it to be sensible. Similarly many medicines have extremely high alcohol content. Nyquil at least used to be 25%.

It's a flavoring. A friend of mine who used to make "kahlua" ice cream had kahlua flavoring, which is just a sugary syrup.


Also, even if there was alcohol, there's not enough for it to actually get anyone drunk.
