I got a call asking who I plan to vote for in the election and how certain I am, because "my opinion is important". Call ended by saying to visit the Pagliuca site. But caller did not say in advance she was from the Pagliuca campaign. Is that legal?

Technically a push poll would be a poll that worded the questions to try to convince you to vote one way. For example, the question "What do you think of the unethical candidate, Pagliuca?" Or the question, "Has Pagliuca ever kicked your puppy?" The question in the original post could be considered a type of push polling (in fact, if you weren't a regular LJ poster, I would assume that you were some sort of anti-Pagliuca sock-puppet)

It's common for the candidates to conduct their own polls. I helped do this for John Kerry in NH in 2004. Conducting poling is a necessary part of a modern campaign, and is different from the ethically questionable practice of push polling.

Yup, it sure would. Also, they're exempt from the do-not-call laws when making calls related to the campaign. I believe they're even still allowed to make robo-calls (although this obviously wasn't) - which is now broadly illegal for the vast majority of purposes.

I just got this call. He said he had two questions for me, but when I answered the first question by saying I was planning to vote for Capuano, he didn't have a second question for me. He didn't identify who he was working for until I asked as he was about to hang up. He didn't sound very professional at all.
