I've been racking my brain and searching the Internet with no luck but I feel sure someone here can help me. What was the name of the café/restaurant/catering place at 136 College Ave. before The Broken Yolk was there (and then obviously before Noor)? You could dine in but they had prepped dishes daily that were most often taken to go. They were open in 2003-04 for sure, plus some time before and after. TIA!

Eater.com reports that "Plans for Davis Square Donuts and Bagels have been scrapped and the space appears to be up for lease with items in the store covered in plastic wrap." The shop was supposed to open in the Community Credit Union building, next to the Rosebud.

The owners of the Gorin Building at 255 Elm Street have sued the owners of Found, a used-clothing consignment shop that closed at the end of January.

The suit alleges that Found owes $21,981.42 in unpaid back rent, that they abandoned the property leaving it in "disarray", and that they broke their lease which obligates them to pay rent through the end of August 2017. ($9472.50/month through 8/31/16, then $9804.03/month through 8/31/17)

So far, this sounds like an ordinary business dispute, but the landlord also twice cites my January 28 post to DSLJ:

COUNT III: Fraudulent Transfer
20. Upon information and belief, the defendants are seeking to use the funds and assets of the defendant Found to start a new company or to establish Found in another location. (See Davis Square Live Journal, dated January 28, 2016, attached hereto as Exhibit "C")

and
COUNT V: Slander/Defamation - Fred Bennett
29. Upon information and belief, on or about January 28, 2016, while in the process of abandoning the Premises, defendant Fred Bennett told a third-party that the plaintiff was "a greedy jerk who jacked up the rent, and is not a good person." (See Exhibit C)

30. The statement by Bennett is factually untrue.

31. Additional comments on the community webpage attached as Exhibit C demonstrate that such defamatory words of defendant Fred Bennett held the plaintiff up to contempt, hatred, scorn, or ridicule or tended to impair his standing in the community, at least to his discredit in the minds of a considerable and respectable class in the community.


I became aware of this lawsuit when a representative from Safety Insurance Company came to my door at 12:55 pm on Tuesday afternoon, May 24. He wanted me to sign an affidavit stating that I made the DSLJ post cited above, and asked me some questions about the appearance of the person whom I quoted in that post. I declined to sign the affidavit, which was my right, but the Safety rep said that this may result in me being subpoenaed as a witness.

He told me that the owners of Found had cancelled their insurance policy the same day as my DSLJ post, and he was very interested in determining whether Fred Bennett had cancelled the policy before or after making the statement quoted above.

If anyone wants to follow along, the case number is 1681CV00413, Misujo Realty LLC vs Davis Square Consignment, LLC Doing Business as Found, Fred Bennett, Meredith Bennett, Defendants, and Eastern Bank NA, Trustee Defendant. The complaint was filed in Middlesex Superior Court which is located in Woburn. You can follow the status of the case by filling out this form, but the content of the filed documents is not online. So far, the defendants have not answered the complaint. Their deadline for doing so is June 15.

from CNN: Sports Authority to close all remaining stores. They tried and failed to find a buyer after declaring Chapter 11 bankruptcy. They have not yet announced when the going-out-of-business sale will begin.

This comes just a few months after City Sports went bankrupt and closed all of its stores.

The Subway store has a "for rent" sign in its window.

I guess it isn't coming back from the flood (or whatever pestilence was directed towards it (low foot traffic?)).

I wasn't a fan but some here were. I was more of a "wow... it has survived this long??" observer.
But then I feel the same about that Dominos pizza venue down the street from it which has been around for... 10 years??
Who buys pizza at "Dominos"? But hey, some people think Olive Garden is fine dining... so go figure (as we say in the midwest).

I just saw a sign on Teriyaki House (on Broadway near Powderhouse; used to be Doo Wee & Rice, and East Asia before that) saying "closed during transition" and "Mint Indian Eatery". I will miss their marinated rice plates, bao baos, and crispy chicken hearts! Anyone know anything about the new place?

A little outside Davis, but Verna's donuts on Mass Ave has big orange stickers on the doors declaring it seized by the constable. Any one know any details? What does it mean to be seized?

Have seen the windows in The Found (consignment shop next to Foundry) and they've all been papered over. Anyone have the scoop?

Found, the used clothing consignment shop at 255 Elm Street, has closed. Someone identifying himself as the owner was standing outside a few minutes ago, and he told me that the landlord is "a greedy jerk who jacked up the rent, and is not a good person." He also said the shop had suffered from shoplifting. He hopes to find a new location where he can reopen it.

The last time I walked by Something GUD's space at Aeronaut Brewery, it was empty and appeared to be disused. Did they move somewhere else? If not, what happened to them?
